Welcome to Vivya CRM, a mobile application provided by Vivya Corp. These Terms and Conditions govern your access to and use of our application and services.

Acceptance of Terms : By accessing or using our application, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use our Services.

Use of the Application : The Application offers CRM solutions with live field sales tracking features designed to enhance sales operations and productivity.

You must register for an account to access the Application. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account, and you agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

Intellectual Property Rights : All intellectual property rights in the Application and its original content, features, and functionality are owned by the Company or its licensors. Your use of the Application does not grant you any rights to our intellectual property except for the limited license granted herein.

The Company grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Application strictly in accordance with these Terms.

User Conduct : You agree not to use the Application to

• Violate any applicable laws or regulations
• Infringe the intellectual property rights of others
• Transmit any material that is defamatory, offensive, or otherwise objectionable
• Interfere with the operation of the Application or the enjoyment of other users.

Termination : We may terminate or suspend your access to the Application immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Disclaimer of Warranties : The Application is provided on an available basis. The Company makes no representations or warranties of any kind, express or implied, as to the operation of the Application or the information, content, or materials included therein.

Limitation of Liability

In no event shall the Company, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from

• your access to or use of or inability to access or use the Application.
• any conduct or content of any third party on the Application.
• any content obtained from the Application.
• unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Governing Law

These Terms shall be governed and construed in accordance with the laws without regard to its conflict of law provisions.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
